1. Agreement
These Terms govern your access to and use of TestAmplify.com and the student services provided by Testamplify LLC.
By using the website, submitting an assessment, enrolling, making a payment, or using a TestAmplify workspace, you agree to these Terms and the Privacy Policy.
2. Eligibility
You must be at least 18 years old and legally able to enter into an agreement.
You must provide information that is accurate and complete. You may not impersonate another person or submit documents you are not authorized to use.
3. TestAmplify Services
TestAmplify provides personalized technical development, real project experience, mentoring, career preparation, and related educational services.
Services may include:
- Career and skills assessments
- Discovery and enrollment consultations
- Personalized learning plans
- Videos and learning resources
- TypeScript, Playwright, API, CI/CD, AI, and automation work
- Taskologic projects and workspaces
- Mentor guidance and project reviews
- Resume, LinkedIn, portfolio, interview, and network support
- VRA video-resume support where included
The exact scope of service is defined in your approved personalized TestAmplify plan.
4. Assessment and Recommendations
Assessment results are preliminary and informational.
AI may assist with summarizing responses and identifying possible strengths, gaps, or discussion topics. AI output does not constitute an admission decision, employment evaluation, legal advice, financial advice, or guarantee.
A human advisor determines the final recommendation, scope, and investment.
TestAmplify may determine that the program is not currently the right fit and may recommend prerequisite preparation or another next step.
5. Personalized Plans and Payment
TestAmplify does not require every participant to purchase the same curriculum or level of support.
Following the discovery call, you may receive a personalized plan describing:
- Your objective and starting point
- The agreed scope
- Expected time commitment
- Included services
- Student and TestAmplify responsibilities
- Investment
- Payment schedule
- Proposed start date
The personalized plan, invoice, or payment agreement becomes part of these Terms.
You are responsible for paying all agreed amounts according to the approved schedule.
6. Cancellation and Refunds
The cancellation and refund terms stated in your personalized plan control.
Unless your plan states otherwise, an initial payment may be eligible for cancellation within seven calendar days when active delivery has not started.
Active delivery includes:
- Personalized roadmap creation
- Taskologic workspace provisioning
- Mentor assignment
- Access to paid program materials
- Project setup
- Live sessions
- Individual reviews or consulting
Once active delivery begins, amounts paid are non-refundable except where required by law or expressly stated in the personalized plan.
If TestAmplify cancels services it has not delivered, the participant may receive a reasonable prorated refund for the undelivered prepaid portion.
Failure to attend, complete assignments, communicate, or use available support does not automatically create a right to a refund.
7. No Employment Guarantee
TestAmplify does not guarantee:
- Employment
- Interviews
- Promotions
- Salary or income
- Certification
- Completion within a specific period
- Acceptance by an employer
- A particular career outcome
Results depend on factors including your experience, effort, consistency, location, communication, market conditions, application strategy, and follow-through.
TestAmplify provides direction, education, practical work, feedback, and career-development support. You remain responsible for completing the work and making career decisions.
8. Student Responsibilities
You agree to:
- Complete your own work
- Participate honestly
- Meet agreed commitments
- Protect confidential information
- Follow project instructions
- Apply mentor feedback
- Communicate blockers promptly
- Respect mentors and other participants
- Use AI responsibly
- Comply with applicable laws
You remain responsible for reviewing AI-generated material and understanding any code or work you submit.
9. Acceptable Use
You may not use TestAmplify services to:
- Harass, threaten, discriminate against, or abuse others
- Upload pornography, unlawful material, malware, or harmful code
- Submit confidential employer information without authorization
- Plagiarize or misrepresent another person’s work
- Commit fraud, spam, phishing, or other deceptive conduct
- Bypass security or access controls
- Share private workspace access
- Disrupt TestAmplify, Taskologic, or related services
- Use program materials to create a competing commercial training product
- Violate intellectual-property, privacy, or contractual rights
TestAmplify may remove content, restrict access, or terminate participation for violations.
10. Intellectual Property
TestAmplify retains ownership of its:
- Curriculum
- Videos
- Templates
- Assessments
- Learning materials
- Project designs
- Brand assets
- Software
- Processes
- Written guidance
- Mentor resources
Enrollment provides a limited, personal, nonexclusive, nontransferable license to use included materials for your own learning and career development.
You may not resell, publish, copy, distribute, scrape, sublicense, or commercially reuse TestAmplify materials without written permission.
11. Student Work
You retain ownership of original work you create.
You grant TestAmplify a limited license to store, review, display internally, comment on, and process that work as needed to deliver the program.
TestAmplify will not publicly use your name, image, testimonial, project, or outcome for marketing without permission.
You must not submit employer-owned, client-owned, confidential, or restricted material unless you have authorization.
12. Workspace Access
Taskologic is the primary student operating environment.
You are responsible for protecting your account and must notify TestAmplify if you suspect unauthorized access.
Workspace access may be limited, suspended, or removed when:
- Payment is overdue
- The agreed access period ends
- These Terms are violated
- Security requires immediate action
- The service is discontinued
13. Third-Party Services
TestAmplify may rely on third-party services for payments, meetings, analytics, communications, AI, hosting, Taskologic delivery, and VRA functionality.
Those services may have separate terms and privacy policies. TestAmplify is not responsible for independent third-party outages, policies, or actions outside its reasonable control.
14. Availability and Changes
We work to keep services available but do not guarantee uninterrupted operation.
Maintenance, security issues, provider outages, product improvements, or circumstances outside our control may affect availability.
We may modify tools, schedules, instructors, mentors, projects, or delivery methods when reasonably necessary, provided the core agreed service remains materially consistent.
15. Suspension and Termination
TestAmplify may suspend or terminate access for:
- Nonpayment
- Fraud
- Abuse
- Repeated misconduct
- Security threats
- Unauthorized sharing
- Material breach of these Terms
When practical, we will provide notice and an opportunity to correct the issue.
Sections concerning payment, intellectual property, limitations, disputes, and confidentiality survive termination.
16. Disclaimer
Services are provided on an “as available” basis to the extent permitted by law.
TestAmplify does not warrant that every resource, recommendation, AI response, project environment, or third-party service will be error-free or continuously available.
You are responsible for reviewing technical work before using it in employment, production, security-sensitive, or business-critical environments.
17. Limitation of Liability
To the fullest extent permitted by law, Testamplify LLC will not be liable for indirect, incidental, special, consequential, punitive, or lost-opportunity damages arising from the services.
Testamplify LLC’s total liability relating to a claim will not exceed the amount you paid to TestAmplify for the specific service giving rise to that claim during the preceding twelve months.
Nothing in these Terms excludes liability that cannot legally be excluded.
18. Informal Dispute Resolution
Before filing a legal claim, you and TestAmplify agree to make a good-faith effort to resolve the dispute directly.
The person raising the dispute must provide written notice describing the issue and requested resolution. The parties will have 30 days to attempt an informal resolution.
19. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, legal proceedings must be brought in a court with jurisdiction in Harris County, Texas.
20. Changes to These Terms
We may update these Terms to reflect changes to services, technology, providers, or legal requirements.
The current version will be posted with its effective date. Material changes may also be communicated through email, the website, or Taskologic.
Continued use after the effective date means you accept the updated Terms.
